Terms and conditions for the use of the nationwide Decidim platform

I. What is the Decidim platform and who can use it?

1. Decidim is a free, open online platform for collective decision-making, consultation, meetings, proposal-making and voting. It aims to promote transparency, co-decision and dialogue in civic processes.

2. The platform is available to anyone who wants to actively participate in civic activities, social projects, the work of non-governmental organisations, public institutions or other forms of social engagement in Poland.

3. The platform can be used by anyone provided that they are connected to the Internet and use a web browser supporting the platform (an up-to-date list is provided on the Decidim website).

4. Users with limited legal capacity may use the Service only with the consent of their statutory representative or legal guardian.

5. The use of the services is tantamount to acceptance of these Terms and Conditions.

6. The owner of the portal is not responsible for any hindrances or inability to provide services, resulting from causes beyond his control, in particular technical failures and the occurrence of force majeure.

II. Who manages the Decidim platform

The owner of the portal is the Foundation Demokracja Przyszłości seated in Gliwice, ul. Zwycięstwa 14/105, 44-100 Gliwice, KRS: 0000930145, NIP: 6312700696, REGON: 520359885, hereinafter referred to as: Owner of the Portal. These Terms of Use set out the rules for using the nationwide Decidim platform, hereinafter referred to as the Platform. Contact with the Website Owner is possible via: e-mail: fundacja@demokracjaprzyszlosci.org.pl or the aforementioned postal address of the Platform Owner's registered office.

III. Rules of use of Decidim

1 Every action on the platform has a meaning. Votes, proposals, comments or participation in meetings are considered as real contributions to civic or organisational processes.

2. Registering means acting as a participant. You can be an active participant or participant in the process, a member/member of an organisation, a representative of an institution or simply a socially engaged person.

3. Decidim is the official working tool for selected initiatives. If you take part in a process organised by an institution, activities on the platform are treated in the same way as those undertaken in person.

4. Activity and responsibility. Participating in votes, filling in surveys, commenting - these are forms of participation that support the effective operation of the platform.

5. The laws and regulations of participating institutions apply accordingly. If an organisation, institution or group has its own rules of procedure - these also apply to activities on Decidim.

6. Free and voluntary. The publication of material on the platform is voluntary and does not entail a claim for remuneration from the user.

IV. Security and liability

1. Your account is yours. Do not share your login details with others. Take care of a strong password.

2. Report problems. If you have a login problem or suspect abuse - report it to the administrator.

3. Impersonation and abuse are prohibited. Such actions may result in temporary or permanent blocking of your account.

4. The administrator may suspend your account. In the case of a breach of the rules, the account may be suspended until the matter is clarified.

V. How do we operate on Decidim?

On the Decidim platform you can:

1. Take part in votes - this is a way of making decisions together with others.

2. Make suggestions - have ideas for changes? You can present them to others.

3. Participate in meetings - choose topics, register and attend online events.

4. Write comments and take part in discussions - support, comment, suggest changes.

5. Complete surveys and forms - help gather feedback and ideas.

6. Create and participate in thematic teams - for work, analysis and planning.

All activities must be undertaken with respect for other participants and the principles of the culture of public debate.

VI. Rules of use and sanctions

In order to make the Decidim platform a safe and substantive space for all, each participant and each participant commits to respect the basic rules:

1. We respect the law. We do not publish illegal content, including incitement to hatred, violence, discrimination or that is disinformation. We respect copyright and the protection of personal data.

2. We discuss with arguments, not ad personam. We express ourselves in a factual manner, referring to the content and opinions, not to the people who make them. We avoid personal attacks, ridicule and irony directed at other participants.

3. We do not use vulgarities or offensive language. Language of expression should be polite, respecting the dignity of all users. Vulgarisms, offensive comparisons and inappropriate language are not acceptable - regardless of intent.

4. Platform moderators have the right to hide or delete comments and content that violate the above rules. In the case of repeated or significant violations, a user's account may be temporarily blocked or deleted.

5. Moderators may edit or correct content published by users only to the extent necessary for clarity, linguistic correctness or adaptation to the platform format, without interfering with the substantive content.

6. In case of violation of other rules of these regulations, the platform administrator may take the following disciplinary measures:

a. warning

b. temporary blocking

c. deletion of the account.

7. In the case of processes organised by specific institutions, the final decision on sanctions and violations of the rules may be taken by the coordinators of the process or authorised bodies.

8. the owner of the portal shall not be held liable for any use of the services contrary to the provisions of the Rules and Regulations.

VII. Intellectual property

1. All rights to the Decidim platform and its content are reserved, unless otherwise stated. This applies to the text and graphic content as well as the layout of the pages and the technical solutions supporting the platform (e.g. forms, chatbots).

2. The copying, modification or dissemination of the content available on the platform, which goes beyond normal use in accordance with the terms of use, is prohibited - unless the consent of the platform owner has been obtained.

3. A person who publishes any content (e.g. texts, graphics, recordings) on the platform grants the owner of the platform a non-exclusive, free and time-limited consent (licence) for its use to the following extent:

a. making the content publicly available on the platform (e.g. through display, playback, publication),

b. saving and processing of such content in IT systems, if this is necessary for the operation or promotion of the platform.

4. The person who publishes content on the platform declares that he or she owns the copyright or other permissions to make it available in accordance with these Terms and Conditions, and that its publication does not infringe the rights of third parties.

5. the source code of Decidim is available at https://github.com/futuredemocracy under the AGPL-3.0 licence.

VIII. Personal data

1. Users' personal data shall be processed in accordance with the applicable law and the privacy policy of https://demokracjaprzyszlosci.org.pl/polityka-prywatnosci/.

2. Each user has the right to inspect his/her data, correct them and request the deletion of his/her account.

IX. Amendments to the Rules

1. The Terms and Conditions may be updated as and when the development of the platform requires.

2. Changes will be announced in advance.

3. Use of the platform after the introduction of changes implies acceptance of them.
